DMCA and Copyright Policy

Overview

ClickUpLocal (“ClickUpLocal”) respects the intellectual property rights of others and expects users of the Platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (“DMCA”), ClickUpLocal has designated an agent to receive notices of claimed copyright infringement.

If you believe that material on the ClickUpLocal Platform (clickuplocal.com) infringes your copyright, please follow the procedure outlined below to submit a DMCA takedown notice.

Designated Copyright Agent

Filing a DMCA Takedown Notice

To file a valid DMCA notice, your written notification must include all of the following:

  1. Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
  2. Identification of the infringing material and its location on the Platform — include the specific URL(s) where the infringing material appears so we can locate it.
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
  5. A statement under penalty of perjury that the information in your notice is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (typing your full name constitutes an electronic signature).

 

Notices that do not comply with these requirements may not receive a response. Submitting a false or materially misrepresenting DMCA notice may expose you to liability under 17 U.S.C. § 512(f).

Our Response to Valid DMCA Notices

Upon receipt of a valid DMCA notice, ClickUpLocal will:

  1. Promptly remove or disable access to the allegedly infringing material;
  2. Notify the user who uploaded or submitted the material (if identifiable) that the content has been removed;
  3. Inform that user of their right to file a counter-notice.

Filing a DMCA Counter-Notice

If you believe that material you submitted to the Platform was removed as a result of a mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:

  1. Identification of the material that was removed and its former location on the Platform (URL or description).
  2. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information, including your full legal name, mailing address, and telephone number.
  4. A consent statement: “I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, for any judicial district in which ClickUpLocal may be found, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”
  5. Your physical or electronic signature.

Submit counter-notices to our Copyright Agent at the address or email above.

Upon receipt of a valid counter-notice, ClickUpLocal will forward a copy to the original complaining party and may restore the material in 10–14 business days unless the complaining party notifies us that they have filed a court action to restrain the alleged infringement.

Repeat Infringer Policy

ClickUpLocal has a policy of terminating the accounts of users who are repeat copyright infringers. A user whose account is terminated for repeat infringement may not re-register.
