This Privacy Policy describes how ClickUpLocal (“ClickUpLocal,” “we,” “us,” or “our”) collects, uses, shares, and protects information when you use our website at clickuplocal.com and related services (collectively, the “Platform”).

This Policy applies to all users of the Platform, including visitors browsing the directory, registered account holders, and users who claim or manage business listings.

By using the Platform, you acknowledge that you have read and understood this Privacy Policy.

1. Information We Collect

We collect information in three ways: information you provide directly, information collected automatically, and information from third-party sources.

1.1 Information You Provide

Account Registration: – Full name – Email address – Password (stored in encrypted form) – Phone number (if you opt in to SMS communications) – Communication preferences

Business Listing Information (provided when claiming a listing): – Business name, category, and description – Business address, phone number, and website URL – Business hours and service area – Representative name, title, email, and phone number – Payment information (for Paid Tier subscriptions — processed by our third-party payment processor; we do not store full payment card numbers) – Business photos and logos you upload

Communications with Us: – Messages you send to our support team – Feedback or inquiries submitted through the Platform – Responses to surveys or promotions (including Giveaway entries)

1.2 Information Collected Automatically

When you use the Platform, we and our technology partners automatically collect certain information:

Usage Information: – Pages viewed, search queries, and features accessed – Business listings clicked, offers claimed, and time spent on pages – Actions that generate Giveaway entries

Device and Technical Information: – IP address – Browser type and version – Operating system – Device type (desktop, mobile, tablet) – Referring URL and exit URL – Time zone and general geographic location (city/region level, derived from IP address)

Cookies and Tracking Technologies: We use cookies, web beacons, pixels, and similar technologies to operate the Platform, remember your preferences, and analyze usage. See our [Cookie Policy] for full details.

1.3 Information from Third-Party Sources

To calculate ClickUpLocal Scores, our algorithms access and process publicly available information about businesses, including:

  • Google Business Profile data (star ratings, review volume, review recency, owner responses)
  • Facebook Business page information
  • Apple Maps and other directory listings
  • Business website data (SSL security status, mobile optimization indicators)
  • Publicly available local awards, community recognition, and news mentions
  • Business registration and longevity data from public records
  • Online review patterns across publicly accessible platforms
  • NAP (Name, Address, Phone) consistency across directories

 

We do not purchase or acquire private consumer data from data brokers for use in scoring. Score calculations are based solely on publicly accessible business information.

2. How We Use Your Information

We use the information we collect for the following purposes:

Providing and Operating the Platform: – Creating and managing your account – Displaying business listings and ClickUpLocal Scores – Enabling offer claiming and Giveaway participation – Processing Paid Tier subscriptions and billing – Sending transactional communications (account confirmations, offer claims, billing receipts)

Communications: – Sending email and/or SMS messages you have consented to receive – Responding to your support inquiries – Notifying Giveaway winners and administering prizes – Sending Platform updates, new features, and announcements (you may opt out)

Calculating and Displaying Scores: – Running our proprietary scoring algorithms against publicly available business data – Updating Scores periodically as underlying data changes – Displaying Scores on business listings visible to all Platform users

Platform Improvement and Analytics: – Understanding how users interact with the Platform – Diagnosing technical issues and improving performance – Developing new features and services – Conducting aggregate, anonymized research and analysis

Security and Fraud Prevention: – Detecting, investigating, and preventing fraudulent activity (including fraudulent listing claims or Giveaway manipulation) – Enforcing our Terms of Service and Acceptable Use Policy – Protecting the rights, safety, and property of ClickUpLocal and Platform users

Legal Compliance: – Complying with applicable laws, regulations, and legal processes – Responding to lawful requests from law enforcement or government authorities – Asserting or defending legal claims

3. How We Share Your Information

We do not sell your personal information. We share information only as described below.

3.1 Publicly Visible Information

The following information about businesses is displayed publicly on the Platform and visible to all users (including anonymous browsers): – Business name, address, phone, website, hours, and category – ClickUpLocal Scores (Reputation Score, Local Presence Score, ClickUpLocal Score) – Business photos, logos, and descriptions – Active offers (Paid Tier businesses only)

Resident profile information (such as your name or account details) is not displayed publicly. Your account information is visible only to you and ClickUpLocal.

3.2 Service Providers

We share information with third-party vendors and service providers who perform services on our behalf, including: – Cloud hosting and infrastructure providers – Payment processing services (for Paid Tier subscriptions) – Email delivery services – SMS messaging services – Analytics and performance monitoring tools – Customer support software – Giveaway fulfillment services

These service providers are contractually obligated to use your information only as directed by ClickUpLocal and in accordance with this Privacy Policy.

3.3 Legal Requirements

We may disclose your information if required to do so by law, or if we believe in good faith that such disclosure is necessary to: – Comply with a legal obligation, subpoena, court order, or governmental request; – Protect and defend the rights or property of ClickUpLocal; – Prevent or investigate possible wrongdoing in connection with the Platform; – Protect the personal safety of Platform users or the public.

3.4 Business Transfers

If ClickUpLocal is involved in a merger, acquisition, asset sale, or other business transaction, your information may be transferred as part of that transaction. We will notify you via a prominent notice on the Platform or by email if your information becomes subject to a materially different privacy policy.

3.5 With Businesses When You Claim an Offer

When a registered user claims a business offer on the Platform, we share the user’s name, email address, and phone number (if on file) with the business that posted the offer. This information is delivered to the business via notification and is also accessible within the business’s ClickUpLocal Business Dashboard CRM as an offer contact record. This sharing is limited to what is necessary for the business to fulfill or coordinate the claimed offer. We obtain your explicit consent to this sharing through a required checkbox on the offer claim form before your information is transmitted.

Optional Business Marketing Consent. At the time of offer claim, you may also be presented with a separate, optional checkbox to consent to receive marketing communications directly from the business that posted the offer. This checkbox is unchecked by default and is not required to complete the claim. If you check this box, the business may use your contact information for marketing communications consistent with the scope of that consent. You may opt out of such communications at any time by following the unsubscribe or opt-out instructions in any message you receive from the business.

Please note: Businesses that receive your contact information through this process are independent third parties. Under the ClickUpLocal [Business Account Agreement], businesses may only use your contact information for offer fulfillment or, if you have separately opted in, for marketing communications within the scope of your consent. Businesses may not sell or transfer your contact information to other third parties. However, ClickUpLocal is not responsible for how those businesses use, store, or protect the contact information you consent to share with them. You should review the privacy practices of any business before claiming an offer if you have concerns about how your data will be used.

3.6 With Your Consent

We may share your information with third parties when you have given us explicit consent to do so beyond the circumstances described elsewhere in this Policy.

4. SMS and Email Communications

4.1 SMS Text Messages

By providing your phone number and opting in to SMS communications, you consent to receive text messages from ClickUpLocal at the number provided, including through the use of automatic telephone dialing systems and/or pre-recorded messages where permitted by applicable law. Consent to receive SMS is not a condition of purchase or use of the Platform. These messages may include: – Account notifications and confirmations – Offer alerts and offer claim confirmations – Giveaway notifications and winner communications – Billing and payment notifications (business accounts) – Platform updates and community announcements – Marketing or promotional messages (only if separately opted in)

Message and data rates may apply. Message frequency will vary based on your account activity and preferences.

To opt out, reply STOP to any ClickUpLocal text message. You will receive one confirmation message and will no longer receive marketing texts from that program. You may continue to receive transactional or account-related texts. To re-enroll, follow the original opt-in process. No sharing of SMS opt-in data. Text messaging originator opt-in data and consent will not be shared with any third parties for marketing or promotional purposes. Information may be shared with subcontractors (such as SMS delivery providers) only to the extent necessary to deliver messages on our behalf.

Mobile carrier disclaimer. Mobile carriers are not liable for delayed or undelivered messages. SMS delivery is subject to your wireless service provider/network availability and is not guaranteed.

For businesses: By providing a phone number during registration, business representatives consent to receive SMS communications regarding their listing, account status, scores, billing, and Platform updates. Business representatives may opt out by replying STOP or contacting support@clickuplocal.com. See our [SMS Program Terms] for full program details.

4.2 Email Communications

We send two types of email: – Transactional emails: Account confirmations, password resets, billing notifications, Giveaway winner notifications. These are required for Platform operation and cannot be opted out of while you maintain an account. – Marketing emails: Platform announcements, new features, local offers digest, and community news. You may unsubscribe at any time by clicking the “unsubscribe” link in any marketing email or by contacting us at support@clickuplocal.com.

CAN-SPAM Compliance. Our commercial email communications comply with the CAN-SPAM Act of 2003. All marketing emails clearly identify ClickUpLocal as the sender, include our valid physical mailing address, and contain a clear and conspicuous mechanism to opt out of future marketing emails. Opt-out requests are processed within 10 business days. We do not send deceptive or misleading email subject lines or headers.

5. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate the Platform, remember your preferences, and analyze usage patterns. Please see our full [Cookie Policy] for a detailed description of the cookies we use and your choices.

In summary: – Essential cookies are required for the Platform to function and cannot be disabled. – Analytics cookies help us understand how the Platform is used. These can be disabled. – Preference cookies remember your settings and choices. These can be disabled. – Marketing cookies are not currently used on the Platform.

You can control most cookies through your browser settings. Disabling certain cookies may affect Platform functionality.

6. Data Retention

We retain your personal information for as long as necessary to: – Maintain your active account and deliver services; – Comply with legal obligations (including tax and financial records); – Resolve disputes and enforce agreements.

Upon account deletion, we will delete or anonymize your personal information within 90 days, except where we are required to retain it by law or for legitimate business purposes (such as records of completed financial transactions or data needed to resolve active disputes).

Subscription and billing records related to Paid Tier business subscriptions are retained for a minimum of 5 years from the date of the last transaction to comply with applicable tax, accounting, and California Automatic Renewal Law requirements.

Giveaway records, including entry data and winner documentation, are retained for a minimum of 3 years from the close of the relevant Promotion Period, as required for promotional compliance purposes.

Publicly available business data used in score calculations is not considered personal information and may be retained in our systems indefinitely.

7. Data Security

We implement commercially reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit (SSL/TLS), encrypted storage of passwords, and access controls limiting who within our organization can access your data.

No method of data transmission or storage is 100% secure. We cannot guarantee the absolute security of your information. If we become aware of a security breach that materially compromises the security, confidentiality, or integrity of your personal information, we will notify affected users in accordance with applicable law, including California Civil Code Section 1798.82 (California’s data breach notification law), which requires notification in the most expedient time possible and without unreasonable delay.

8. Children’s Privacy

The Platform is intended for users 18 years of age and older. We do not knowingly collect personal information from individuals under 18. If we become aware that we have inadvertently collected information from someone under 18, we will delete that information promptly. If you believe we have collected information from a minor, please contact us at legal@clickuplocal.com.

9. California Privacy Rights (CCPA / CPRA)

This section applies to California residents and supplements the rest of this Privacy Policy.

Note: We do not collect Social Security numbers, financial account numbers, biometric data, health data, or precise geolocation data.

9.2 Sources of Personal Information

We collect personal information directly from you, automatically from your device and browser, and from publicly available third-party sources (for score calculation), as described in Section 1.

9.3 Business Purposes for Collection

We collect personal information for the business purposes described in Section 2.

9.4 Sale and Sharing of Personal Information

We do not sell your personal information. We do not share your personal information with third parties for cross-context behavioral advertising purposes. If this changes, we will update this Policy and provide you with the right to opt out.

9.5 Your California Privacy Rights

As a California resident, you have the following rights:

Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources, our purposes for collection, and the categories of third parties with whom we share it.

Right to Delete: You may request deletion of personal information we have collected about you, subject to certain exceptions (e.g., information needed to complete a transaction, comply with a legal obligation, or for security purposes).

Right to Correct: You may request correction of inaccurate personal information we maintain about you.

Right to Opt-Out of Sale/Sharing: As noted above, we do not sell or share personal information for behavioral advertising. If we do so in the future, you will have the right to opt out.

Right to Limit Use of Sensitive Personal Information: You may direct us to limit the use and disclosure of sensitive personal information (such as your account credentials) to only what is necessary to provide the services you requested.

Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. We will not deny you services, charge you different prices, or provide a lower quality of service because you exercised your rights under the CCPA.

9.6 How to Submit a Privacy Request

We will respond to verifiable consumer requests within 45 days. We may need to verify your identity before processing your request. If we require more time (up to 90 days total), we will notify you.

You may designate an authorized agent to submit a request on your behalf, subject to verification requirements.

Right to Appeal. If we deny all or part of your privacy request, you may appeal that decision by submitting a written appeal to privacy@clickuplocal.com with the subject line “Privacy Request Appeal.” Please include your original request, the decision you received, and the reason you believe the denial was incorrect. We will respond to your appeal within 45 days. If your appeal is denied, you may contact the California Privacy Protection Agency (CPPA) to submit a complaint at cppa.ca.gov.

9.7 California “Shine the Light” Disclosure

Under California Civil Code Section 1798.83 (“Shine the Light”), California residents may request information about whether ClickUpLocal shares personal information with third parties for those third parties’ own direct marketing purposes. ClickUpLocal does not share personal information with third parties for their own direct marketing purposes. 9.8 Global Privacy Controls (GPC)

ClickUpLocal honors Global Privacy Control (GPC) signals as a valid opt-out of the sale and sharing of personal information, as required under the California Privacy Rights Act. If your browser or device sends a GPC signal when you visit the Platform, we will treat it as an opt-out of sale and sharing. Because we do not currently sell or share personal information for behavioral advertising, GPC signals do not change the way we process your data in practice — but we will honor them regardless.

10. Other State Privacy Rights

As ClickUpLocal expands to serve users in other states, additional privacy rights may apply. We are committed to complying with applicable state privacy laws, including those in states that have enacted comprehensive consumer privacy legislation. If you believe additional rights apply to you based on your state of residence, please contact us at privacy@clickuplocal.com.

11. Do Not Track

Some browsers transmit “Do Not Track” (DNT) signals. The Platform does not currently respond differently to DNT signals. We will update this section if our practices change.

12. Links to Third-Party Sites

The Platform may contain links to third-party websites. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the new Policy on the Platform with an updated effective date and, if you are a registered user, by sending you an email notification at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Policy.
